Purchase Agreement

We are so happy that you have chosen to add one of our sweet babies to your family! We pray that you will enjoy a long & happy life together.

Every family or individual who chooses to buy one of our puppies must read our health guarantee & the purchase agreement below, as well as fill out the form below agreeing to purchase one of our puppies. Thank you

to us if  they viewed our webpage on their phone, tablet, kindle, iPod etc.
We recommend that you send the purchase agreement to us from a
stationary computer. We apologize for this inconvenience! ***

to us today to confirm that the puppy is still available & we have agreed
to hold the puppy specifically for you! ****

 

Puppy Contract

Our puppies are honestly represented & evaluated as accurately as possible by us & our vet. To the best of our knowledge, the parents & the puppy are healthy, free from disease temperamentally & physically sound & are average specimins of the breed as presented in the breed standard. Vaccinatons & deworming are current at the time of sale. The puppy you have placed on hold with us is the puppy you will receive.

Deposit/ Payment

We cannot place a puppy on hold without a deposit. No puppy is considered reserved unless we receive your purchase agreement AND your deposit for your puppy. This deposit signifies the intent on the part of the buyer to follow through with the purchase of the puppy.

Upon receipt of your deposit & purchase agreement, your puppy will be taken offline & held for you until he/ she is ready to come home.

The balance owed on the puppy is due by 7 weeks of age or one week prior to travel. Failure on the behalf of the buyer to receive your puppy by the specified date or have your puppy paid in full by the time he or she is 7 weeks old will mean forfeiture of all payments & any rights the potential buyer has towards this puppy or any other puppy.

If for some reason, you find yourself unable to take the puppy we have held for you home, we will gladly transfer your deposit to a different puppy that we may have available at another time. There is no time limit on the deposit and you can transfer it to someone else if you choose.

Refunds

The $300 deposit, any services rendered (including, but not limited to ear cropping fee, Puppy Kindergarten classes, spay or neuter fees etc) & any shipping fees (where applicable) are non-refundable, unless we can not provide the puppy you have chosen due to unforseen circumstances. We do not offer refunds. No money will be refunded.

We will not refund money nor pay anyone's vet bills. We work hard to provide a healthy companion but can't be responsible for other vets' opinions. It is your responsibility financially to continue regular check ups, vaccinations etc at your veterianian clinic. The seller is not responsible for any medical, dental or surgical proceedures to maintain a dog's health or well being after the buyer assumes ownership.

Returns/ Rehoming/ Owner Surrender


If for any reason you are not able to keep your Heritage Farms companion,
we (as the breeders) reserve first rights to the puppy. We will help you find a free home
for them or take them back at any time during their life.
No refund will be offered at this time.

Our puppies are considered the property of Heritage Farms if the
original buyer can no no
longer retain possession. The dog will be returned
in good health with all paperwork including registration papers &
medical records to Heritage Farms within 14 days.

Under no circumstances will the buyer rehome the dog or allow him/ her to
be surrended to the pound or any rescue center.

Rehoming of our puppy without our written permission is considered a breach
of contract & the buyer will be sued for the actual value of the puppy
at the time of the original sale (purchase price) & any fees incurred
to regain possession of the dog.

Heritage Farms is not responsible for shipping charges to transport a puppy (original, return or replacement) back & forth in the event of a return or replacement for any reason.

Replacement

Should an unexpected, fatal accident happen to the puppy while the puppy is in our care; OR if a puppy is diagnosed within two years of any inherited, genetic or congenital disorder (from its parents) which is considered by your vet to seriously impact the dog's quality of life, is life threatening and your vet recommends euthasia OR requires expensive continuous medical treatment for the duration of the dog's life, we will replace the puppy at our discretion with another puppy of comparable cost, breed etc as soon as one becomes available. We do NOT refund money nor pay anyone's vet bills. If you choose to continue with large, expensive medical bills, this is your sole responsibility.

Replacement of the puppy is the sole discretion of Heritage Farms. A replacement puppy is subject to availability, breeder's first choice for our breeding program etc.

Buyer understands that a replacement puppy is ONLY to be given if a valid hereditary problem is found & not due to accident or illness. Replacement will NOT be given if the puppy was bred, spayed, neutered or euthanized without the seller's permission. Buyer understands that the replacement puppy may not be of the same sex, age, from the same parents etc.

In the event that no puppies are available at that time to replace your puppy, the buyer will be placed on a waiting list & will be notified when a puppy of comparable breed, value etc becomes available.

Please call us for advice & we will evaluate all problems on a case by case basis. Heritage Farms will not replace a puppy that dies because the new owner waited too long to get medical attention for the new puppy; if the puppy was dropped or injured maliciously; OR where neglect or abuse by the new owner or misdiagnosis by their vet could have caused the problem.

Failure on the behalf of the buyer to co operate & respond to our phone calls, emails etc within a specificed time frame cancels the transaction of a replacement puppy.

Heritage Farms is not responsible for shipping charges to transport a puppy (original, return or replacement) back & forth in the event of a return or replacement for any reason.

If the buyer wishes the retain the original puppy, he or she waives the right to a replacement puppy unless otherwise agreed upon in writing from the seller, stating that the buyer may keep the original puppy and also receive the replacement puppy,

At the discretion of Heritage Farms, if you are a breeder & you have payed the additional fee for full registration & breeding rights: Any undescended testicles must be diagnosed by your vet at your puppy's initial/ first visit (within 72 hours of receiving him). If this does happen, the buyer can return the puppy within 72 hours of the purchase at the buyer's expense for a replacement puppy at the discretion of Heritage Farms. NO replacement if the puppy will not be used for breeding or if the buyer didn't purchase full registration or breeding rights (at an additional cost).

Guarantee

We offer a two year genetic health guarantee with our puppies that takes effect two years from the date they were born. The buyer understands that any & all guarantees expire two years from the puppy's date of birth. This guarantee only applies if you received the puppy directly from us & not through
a third party.

Activating Your Puppy's Health Guarantee

IN ORDER TO ACTIVATE THIS HEALTH GUARANTEE, you MUST 
register his or her microchip in your name within two weeks
of your new puppy coming home to you or this guarantee
will be null & void. This ensures that if your puppy is ever
lost or stolen, he or she will be safely reunited with
you. This is of the utmost importance! If you do NOT
activate his or her microchip, some aspects of this
health
guarantee may not apply to you.

IN ORDER TO ACTIVATE YOUR  HEALTH GUARANTEE after your puppy
comes home, you MUST take your puppy to see your licensed
veterinarian within 72 hours of his or her arrival, for a "healthy
puppy check up" or this guarantee will be null & void.
This is to ensure that your puppy did not get sick or stressed
out in his or her travel to you. If you do NOT take your puppy
to a vet within 72 hours of his or her arrival, some aspects
of this health guarantee may not apply to you.

If the puppy doesn't pass his or her 72 hour health exam, the buyer must notify the seller immediately, within the first 72 hour time period or this contract is deemed null & void.

In the event that the buyer returns the puppy at this time, he or she must be returned within 7 calendar days of the purchase date with all of his or her paperwork, registration papers,, health records etc.

Registration

*** Note: We are selling our puppies as companions (with limited registration),
not for breeding, unless otherwise stated on your contract.
We do require an additional fee for full registration & breeding rights.

*** Note: Your puppy automatically comes with APRI registration
papers. If you would like your puppy to be registered with the AKC,
please let us know. Most of our puppies are dually registered.
In this instance, you would fax or mail a copy of your APRI

registration papers to the AKC, after the litter of puppies
has been registered. Please contact us BEFORE purchasing
your puppy, if you want this option. Thank you.***

Breeding Rights/ Full Registration

*** Note: We are selling our puppies as companions (with limited registration),
not for breeding, unless otherwise stated on your contract.
We do require an additional fee for full registration & breeding rights.

The buyer also agrees that if he or she did purchase breeding rights and/ or full registration, the puppy is allowed to breed under any circumstances. If for any reason it is discover that the puppy remains unaltered & was used for any type of breeding (producing a litter of puppies either as purposely bred or by an accidental breeding), Heritage Farms has the right to seek compensation in the amount $5,000 & all rights to the dogs & all offspring produced with no compensation to the buyer.

If you have purchased full registration & breeding right (extra fee) from us, we recommend tht you do not breed your dog before he or she is 2 yars old & has passed the necessary health exams (OFA, CERT etc) & will only breed him or her if it has been cleared with a clean bill of health.

Shipping/ Delays/ Weather


*** Note: If your puppy is coming home during the
winter or summer months, there is a chance that his or her
flight will be postponed, due to cold or hot weather***

If it is not safe to release the puppy due to the weather, size of the puppy, puppy's eatin habits OR other unsafe situations, Heritage Farms reserves the right to move the travel date at our discretion. In this situation, the next available ship date (a Tuesday or Friday) will be chosen.

Puppy's Size at Time of Travel


*** Note: If your puppy is small at 8 weeks old & we are
concerned about him or her traveling, we may decide to
hold it 4 or more additional weeks, to make sure he
or she is big enough to travel. The health, safety &
happiness of our puppies is very important to us***

If it is not safe to release the puppy due to the weather, size of the puppy, puppy's eatin habits OR other unsafe situations, Heritage Farms reserves the right to move the travel date at our discretion. In this situation, the next available ship date (a Tuesday or Friday) will be chosen.

Your Responsibility

By taking ownership of one of our puppies, you agree that you will never rehome the puppy OR allow the puppy to end up in a shelter or rescue.

You agree to provide good care for your new puppy, by spaying or neutering it, unless otherwise stated on your contract.

If the puppy doesn't pass his or her 72 hour health exam, the buyer must notify the seller immediately, within the first 72 hour time period or this contract is deemed null & void. In the event that the buyer returns the puppy at this time, he or she must be returned within 7 calendar days of the purchase date with all of his or her paperwork, registration papers,, health records etc.

Buyer agrees to not take the puppy to public areas where dogs are known the frequent until ALL of the puppy vaccinations are given; nor to visit homes of family or friends who knowingly had a puppy infected with parvovirus as this disease can live in an environment for many years.

It is your responsibility financially to continue regular check ups, vaccinations etc at your veterinary clinic. The most important thing you can do for the good health of your puppy is to complete the worming & vaccinations needed to ensure your puppy continues to enjoy good health. Your vet will set you up on a schedule for this, so follow their advice. We cannot guarantee total immunity for your puppy when he or she first comes hom to you as the shots he or she has received are just a few in a series & your vet will need to complete the remaining vaccinations in a timely fashion.

This contract & health guarantee is void if the buyer fails to provide the required immunizations, wormer & medical treatment for their puppy. This contract is null & void if the dog is overweight or underweight while in your care.

Buyer agrees to keep us updated on any significant changes in their contact information & agrees to notify Heritage Farms of any serious health, behavioral, training etc conditions that the dog may develop in life, as well as photos & info as the puppy grows & adjusts to his or her new home.

The buyer agrees to refrain from making any disparaging, dishonest, negative or uncomplimentary statements on any publically accessible medium (such as the Internet or in print) regarding or against Heritage Farms and/ or Mark & Kate Ritter. Failure to comply with this requirement voids the contract & health guarantee on their puppy.

Buyer agrees to provide lifelong commitment, a comfortable environment, proper housing, proper nutrition, fresh water available at all times, prompt medical attention, proper grooming, good quality food, love, attention, time, adequate exercise, responsible care etc for the dog. This includes keeping the dog parasite free, an annual teeth cleaning & up to date on all vaccinations to ensure longevity of life. Buyer agrees to provide a safe environment for the dog & never allow the dog to roam freely without proper fencing or supervision. Buyer agrees to not tie the dog to a chain, leave outside unattended or to treat/ encourage theh dog to show aggression or viciousness. Rough play is not allowed as it encourages aggressive behavior.

Buyer agrees to not euthanize the dog for any reason unless he or she first contacts the breeder & it is agreed upon by both parties unless it is life threatening due to illness or injury & an immediate decision must be made. In this instance, documentation must be provided to the seller by the attending veterinarian.

Buyer is encouraged to enroll the puppy in baic obedience class.

It is the buyer's responsibility to review information on the dog breed, including information on temperament, exercise, grooming, feeding, training & common medical conditions that affect the breed.

Buyer assumes all responsibility for the puppy upon its arrival in their home. Heritage Farms is not responsible & cannot be held laible for a puppy's personality, health (vision, dental, etc), temperament, training (or lack thereof), disposition or actions once the puppy is in your care. Dogs depend on a kind owner that will take care of them & love them. If your dog doesn't receive the time, exercise, love & attention that he or she deserves, bad vices & behaviors can develop due to boredom, neglect and abuse.

After Your Puppy Comes Home

If you think your puppy is sick when he/ she arrives, please call us immediately or you may void this guarantee. We may help you decide if your puppy needs to go to the vet. If it is an emergency, take the puppy to the vet immediately & contact us when you arrive.

The seller is not responsible for any medical, dental or surgical proceedures to maintain a dog's health or well being after the buyer assumes ownership.

Food Recommendations

How you feed your puppy is very important. Follow your vet's advice for what brand of food to feed your dog & what amount he or she needs daily. We recommend feeding them Royal Canin, Iams, Eukaneuba, Purina, Diamond or any other top quality brand. Remember that just like humans, dogs are what they eat!

Litigation/ Court Fees

All attorney fees involved in fulfilling this contract are the responsibility of the buyer, as well as all lodging, legal, court costs, transportation, shipping fees etc in the event of a legal dispute.

In the event of a legal dispute, the buyer agrees to return the puppy to the seller until all court proceedings are finalized. It is further agreed upon that the place of venue shall be Pike County, Missouri.

The buyer releases & holds harmless Mark & Kate Ritter of Heritage Farms from all legal litigation & any/ all liabilities (accidental fall, dog bite etc) that might occur while we/ our children/ our gests are attending and/ or participating in any events/ activies on the seller's property.

Non-transferrable

This contract & health guarantee are non-transferable in the event that the buyer decides to sell the puppy. This guarantee & contract are only valid you received your puppy directly from us (no third party involved).

Miscellaneous

All previous drafts of this health guarantee & contract are invalid. The current health guarantee & contract supercedes any & all previous agreements. This contract is null & void if all terms & conditions are not fulfilled by buyer. Buyer understands that any & all guarantees expire 2 years from the date of the puppy's birth.

This is considered to be a complete bill of sale. This is the total agreement between the buyer & seller. No other terms or conditions are valid to this sale.

This contract is deemed to be a legally binding contract & is under the jurisdiciton of Missouri, in the county of Pike. State of Missouri rules & regulations concerning the sale of animals apply to this sale & govern all warranties & guarantees.

It is agreed that if the buyer breaches any part of this contract, the seller has full rights to pursue a civil lawsuit for breach of contract damages in the amount of $5,000.

As the breeder, we reserve the right to refuse to sell a puppy to an individual & cancel the sale of any puppy at any time, up until he or she arrives at your home, for any reason we deem appropriate.

The buyer hereby acknowledges upon receipt of the puppy that he/
she has read, agrees to the terms & accepts full responsibility
for the health & well being of the purchase puppy.

match your driver's license.
Or else you cannot pick up your puppy.
